The Constitutional Council is now hearing the case refered to them by the Cour de Cassation, as  mentioned here before: http://irishpinkadoptions.com/2010/11/16/2010-11-16-france-constitutional-court-to-decide-if-marriage-ban-is-illegal/

2 women who have lived together for 14 years, and are raising 4 children have initiated the legal proceedings to get married.

The PACS, available to them, is similar to the Irish Civil Partnership: it casts away the natural rights of children to be raised in a family protected by Society.

Listening  to the layer, Emmanuel Ludot, we can infer that they are not doing it to make a militant stand, but because they respect the sanctity of marriage and the importance of family. Obviously French government, just like the Irish one, have no regard for them, or for the children rights that ensue.

The decision is anticipated to be a cope out, as it was in the past when the Council was asked to rule on “homoparentality”. They then rules that it was a matter for the Parliament to decide and that in the meantime only married couples could have joint parental authority in the case of an ordinary/simple adoption.
